Morrison & Foerster has settled a malpractice or billing dispute, depending who's side your on, with former client E-Cast.
Ragesh Tangri, the Durie Tangri lawyer who represented MoFo, issued a prepared statement:
As a result of the process of settlement discussions, the parties agree that this dispute, which once included claims of malpractice, has been resolved as a billing dispute," he said. "The dispute has been settled upon terms that are confidential, but which involved a compromise payment by Ecast to Morrison & Foerster."
E-Cast had sued MoFo, alleging that lead partner Gerald Dodson delegated work to nearly 50 attorneys, despite having promised to take the lead himself. And E-Cast alleged that MoFo overbilled, charging $4.8 million for its services. And it wasn't happy about doing poorly in the underlying patent case that MoFo was handling.
MoFo fired back that E-Cast wasn't paying its freakin’ bills.
And there you have it, E-Cast didn't pay the high bill, kicked some dirt on MoFo and paid a bit less. In these trying economic times, there's nothing like a malpractice case to get a good discount on the hourly rate.
