Erstwhile Cisco lawyer and anonymous blogger Rick Frenkel was on the stand today in the Patent Troll Tracker defamation trial. Our colleague Joe Mullin is braving the Texas heat to bring you all the latest. Check out his excellent coverage on his Prior Art blog (or here, as of this evening).
Frenkel was an in-house lawyer at Cisco whose postings on the anonymous Patent Troll Tracker blog offended two prominent Texas IP lawyers, Johnny Ward Jr. and Eric Albritton. In the posts, Frenkel accused them of gaming the system by getting court clerks to change the dates on filings so they could win the race to the courthouse in a patent case. They sued Frenkel and Cisco for defamation once Frenkel was unmasked at the Troll Tracker. Mullin has all the juicy details about Frenkel being grilled by Albritton’s lawyer Nick Patton. The highlight? Frenkel, now a lawyer at Wilson Sonsini, is sorry that he called the rocket docket Eastern District of Texas a “banana republic.” Now he’s down there feeling the heat himself.
