From the Ninth Circuit conference in Sun Valley:
When we got to the Ninth Circuit conference yesterday, we noticed all the suited security guards milling about. Of course, we thought they were Secret Service, here for Justice Anthony Kennedy. But come this morning, they were still blanketing the resort, even though Kennedy has not been as visible.
Turns out the guards are probably here just as much for Chief Judge Alex Kozinski as for Kennedy. Wherever Kozinski goes, Legal Pad has noticed a federal marshal accompanying him. Is it because the LA Weekly hired Kozinski nemesis Cyrus Sanai to cover the conference?
According to one circuit official, the marshals are not here specifically for Kozinski, but they are "aware" of the situation with Sanai. We saw the lawyer turned reporter this morning; he said he was thrown out of a cocktail reception last night after being told it was closed to the press. But he was quietly eating lunch today, and appeared to cover the morning panels without incident.
